GENERAL TERMS AND CONDITIONS FOR PACKAGE TRAVEL AGREEMENTS
The combination of travel services offered to you is a package tour within the meaning of Directive (EU) 2015/2302, transposed by the Act of 21 November 2017 on the sale of package tours, linked travel arrangements and travel services.
As a result, you can claim all EU rights that apply to package travel. Baguet Velo Events BV is fully responsible for the proper execution of the entire package travel.
Baguet Velo Events BV also has the legally required protection to pay you back and, if transport is included in the package, to repatriate if it becomes insolvent.
Basic rights under Directive (EU) 2015/2302:
- Before concluding the package travel agreement, the traveler will receive all essential information about the package travel.
- The liability for the proper execution of all travel services included in the agreement always rests with at least one professional.
- The traveler gets an emergency telephone number or information on a contact point through which he can contact the operator or travel agent.
- Passengers can transfer the package, subject to a reasonable period and possibly to the payment of additional costs to another person.
- The price of the package can only be increased if specific costs increase (for example fuel prices), if this is explicitly included in the agreement, and in any case no later than twenty days before the start of the package. If the price increase is higher than 8% of the price of the package, the traveler can cancel the agreement. If the organizer reserves the right to a price increase, the traveler is entitled to a price reduction should the relevant costs decrease.
- If, after the start of the package, significant elements of the package cannot be delivered as agreed, a suitable alternative arrangement must be offered to the traveler, at no extra cost. If the services are not performed in accordance with the agreement and this has significant consequences for the implementation of the package and the organizer has not remedied this problem, the traveler may cancel the package travel agreement without payment of a cancellation fee.
- The traveler can cancel the contract in exceptional circumstances without payment of a cancellation fee before the start of the package, for example when there are serious security problems at the destination that are likely to have consequences for his package.
- In addition, the traveler can cancel the contract at any time before the start of the package travel against payment of an appropriate and justified cancellation fee.
- If, after the start of the package, significant elements of the package cannot be delivered as agreed, a suitable alternative arrangement must be offered to the traveler, at no extra cost. If the services are not performed in accordance with the agreement and this has significant consequences for the implementation of the package and the organizer has not remedied this problem, the traveler may cancel the package travel agreement without paying a cancellation fee.
- In the case of travel services that have not been performed or have not been performed properly, the traveler is also entitled to a price reduction and / or compensation.
- The organizer is obliged to provide assistance to travelers in difficulty.
- If the organizer or retailer becomes insolvent, the amounts paid will be refunded. If the insolvency of the organizer or, if applicable, the retailer commences after the start of the package and the transport is included in the trip or holiday, the traveler will be repatriated. Baguet Velo Events BV has provided itself with insolvency protection with the Travel Guarantee Fund. When services are not provided due to the insolvency of Baguet Velo Events BV, travelers can contact this entity or, where appropriate, the competent authority (Metrologielaan 8, 1130 Brussels, Belgium, info@gfg.be, + 32- (0)2/240.68.00).
